Recognition of health professions qualifications privacy

Information pursuant arts. 13 and 14 of the General Data Protection Regulation - GDPR 2016/679 concerning the processing of personal data collected within the procedures of recognition and certificate issuance for health professional qualifications obtained in EU and non-EU countries.

The Italian Ministry of Health, acting as official Authority vested in the controller of the data provided for the procedures allowing the mobility of health professionals within and outside the European Union, informs you of the following:

Objectives of the Regulation: in Italy, data processing is carried out on the grounds of Legislative Decree dated 9 November 2007, no. 206 and subsequent amendments, that is the national law implementing the EU Directive 2005/36/EC, which regulates the recognition of professional qualifications obtained in one or more EU Member States and which enables any qualified person to pursue the same profession in another Member State.

As for qualifications obtained in non-EU countries, the legal basis for data processing is art. 37 of Legislative Decree dated 25 July 1998, no. 286 and subsequent amendments, “Testo unico delle disposizioni concernenti la disciplina dell’immigrazione e norme sulle condizioni dello straniero” (Consolidated Law concerning immigration and the status of foreigners) and DPR dated 31 August 1999, no. 394 and subsequent amendments, “Regolamento recante norme di attuazione del testo unico delle disposizioni concernenti la disciplina dell’immigrazione e norme sulle condizioni dello straniero, a norma dell’articolo 1, comma 6, del decreto legislativo 25 luglio 1998, n. 286” (Regulation providing measures for the implementation of the previously mentioned Consolidated Law, in compliance with art. 1 paragraph 6 of Legislative Decree dated 25 July 1998, no. 286).

Type of data: the necessary data for the procedures of recognition or certificate issuance can be the following, according to the kind of application:

  • your personal details and contacts;
  • data concerning your degrees and professional qualifications;
  • data concerning your previous professional experience in your country of origin/provenance;
  • relevant data for possible judicial proceedings (disciplinary and/or administrative and/or criminal procedures) carried out in relation to the profession pursued in your country of origin/provenance and for which you apply, for recognition or certification

Data processing: the Italian Ministry of Health processes the data you provide as far as they are necessary for the implementation of the provisions stated in point 1 of this information document. Processing consists of: collection, storage, consultation, drawing-up, erasure and disclosure of data, through publication of the recognition decree of the professional qualification on the official website of the Italian Ministry of Health. Your data are processed and stored in compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 26 April 2016, in the information systems and/or in hardcopy archives of the Italian Ministry of Health.

Data publication and disclosure: your identifiable data (name, surname, date and place of birth), as well as data concerning your professional titles included in the recognition decree, are published on the official website of the Italian Ministry of Health and can be transmitted to other national or EU Public Administrations and, upon request, to the Judicial Authority.

Who is authorised to process data: your personal data can be processed only by staff specifically appointed by the controller. The controller can rely upon this authorised staff after specific designation as “processors”, in accordance with art. 28 of GDPR 2016/679.

Data transmission: for the procedures of recognition or issuance of certificates, data can be transmitted in digital or printed format, according to the provisions in the relevant section of the official website of the Italian Ministry of Health.

Data storage: the data you provide will be stored in the Ministry’s hardcopy library or information system for the time your recognised qualification or certification authorises you to pursue your profession and in any case for the time that would be necessary to solve possible disputes.

Rights of the interested party: according to arts. 15 to 22 of the Regulation (EU) 2016/679, as far as your personal data are concerned, any time you can exercise the right to:

  • ask for confirmation of your data existence
  • get indications concerning the purposes of processing, the categories of personal data, the recipients or categories of recipients to which your personal data were or will be transmitted, and the storage period
  • ask for rectification
  • ask the Italian Ministry of Health for access to your data
  • lodge a complaint with a supervisory authority
