Brexit, it is approved the withdrawal agreement of the United Kingdom from the European Union

The European Parliament, on 29 January 2020 in Brussels, approved the Brexit Agreement agreed by the British government and the European Commission. It was the last formal step necessary to complete the first phase of the United Kingdom's exit from the European Union: the agreement had already been approved by the British Parliament and by the other European institutions involved, the Commission and the Council.

After the ratification and entry into force of the Withdrawal Agreement and during the transition period, from 1 February 2020 until 31 December 2020, EU law on free movement and coordination of social security will continue to apply to Italian citizens in the United Kingdom and to British citizens in Italy and the EU.

During the transition period, the UK government and the European Commission will have to negotiate their future relations, especially in terms of trade and social security.

Health care

As far as the coordination of social security systems for access to healthcare is concerned, until 31 December 2020 the current European social security rules continue to apply to British patients in Italy and Italian patients in the UK. In a similar way, until 31 December 2020, the Directive 2011/24/EU on the application of patients’ rights in cross-border healthcare continues to be applied to British citizens in Italy and to Italian citizens in the UK.

Recognition of professional qualifications

Articles 27-29 of the Withdrawal Agreement govern the recognition of professional qualifications until the end of the transition period. In particular, the current EU legislation will continue to apply to the United Kingdom to the period in question, with particular reference to the freedom of establishment pursuant to Title III of Directive 2005/36/EC in relation to all the recognition regimes provided therein, to cases provided for by art. 3 (3) and recognition based on the European Professional Card.

During the transition period, therefore, both in the case of professional qualifications obtained in Italy and in the case of professional qualifications obtained in the United Kingdom, the recognition decisions of these qualifications will continue to have effects, respectively, in the United Kingdom and in Italy if the recognition took place on the basis of the rules indicated above.

Since the United Kingdom, to this aim, remains a fully-fledged EU Member State for the duration of the transition period, the provisions of Directive 2005/36 / EC will continue to apply to applications for recognition in Italy of professional qualifications obtained in the United Kingdom submitted before the end of the transition period.

For the same reasons, applications submitted in the United Kingdom with reference to the recognition of professional qualifications acquired in Italy before the end of the transition period will benefit from the already mentioned provisions of Directive 2005/36/EC.
